Based on a preliminary review of the information you have shared with us, your Will does not address critical issues, such as what happens if assets go to your grandchildren or effective instruction for how your house should be handled.

Updating the Power of Attorney

Based on a preliminary review your backup Power of Attorney will likely have procedural issues working with financial companies.

Coordinating Benefits

Think of your Will as the “catch all” for anything without a beneficiary and an instruction book for any special contingencies. Everything that “passes through” the Will goes through probate. Assets with successor owners listed supersede your will and generally need special instructions to transition as desired. Ideally, we rely on beneficiary designations (and the like) and we use the will as a reference for more complicated instruction and as a failsafe for any assets without beneficiary designation. This allows for flexibility, control, easier administration, and an easier periodic update process.
